Terms of Trade Policy
1. Orders and Acceptance
Orders placed via the Shopify website or other channels constitute an offer from the buyer to purchase goods under these terms of trade. Acceptance by the seller may occur through confirmation emails or official invoices.
2. Pricing and Payment
All prices are listed in New Zealand dollars and are inclusive of GST unless stated otherwise. Payment must be made in full prior to delivery, via approved online payment methods. Ownership of goods does not transfer until payment is received in cleared funds.
3. Ownership and Risk
Ownership of the goods remains with the business until full payment is received. Risk in the goods passes to the customer upon delivery. Goods must not be resold, modified, or transferred until payment is completed.
4. Delivery
Delivery times are estimates only. Delays beyond control do not constitute grounds for cancellation unless otherwise stated. The seller is not liable for delivery delays outside its control.
5. Returns, Refunds, and Warranties
Refer to the store’s Return and Refund Policy for all procedures, conditions, and timeframes relating to returns and exchanges. Consumer rights under the Fair Trading Act and Consumer Guarantees Act will be honored.
6. Liability and Warranty
The seller warrants that all goods are of merchantable quality. Limited liability applies for damages, defects, or loss, and does not cover indirect or consequential losses beyond the value of the goods as invoiced.
7. Dispute Resolution
Any disputes will be dealt with in accordance with New Zealand law. Alternative dispute resolution may be considered before any court proceedings.
8. Intellectual Property
Designs and content on the website remain the property of the business and may not be reproduced or resold without written permission.
9. Privacy
Customer data collected is managed according to the Privacy Policy published on the website and is used only for business operations and communication.
